TERMS AND CONDITIONS FOR BOOST SPORTSWEAR AS

1. The Parties

Hereinafter referred to as “the seller”.

The buyer is the consumer placing the order and is hereinafter referred to as “the buyer”.

 


 

2. The Agreement

The agreement consists of these terms and conditions, information provided in the ordering solution, and any specially agreed terms. In case of conflict, special terms prevail, provided they do not contradict mandatory legislation.

The purchase is governed by applicable Norwegian law, including the Contracts Act, Consumer Purchases Act, Right of Withdrawal Act, Marketing Control Act, and E-Commerce Act.

 


 

3. Prices

All prices displayed in the online store are total prices and include VAT and any other applicable taxes or fees.

The buyer shall not bear any costs that were not clearly disclosed prior to placing the order.

 


 

4. Conclusion of Agreement

The agreement becomes binding on both parties once the buyer has submitted their order.

However, the agreement is not binding if typographical or input errors have occurred in the ordering solution or in the buyer’s order, and the other party realized or should have realized such error.

 


 

5. Payment

The seller may charge payment once the goods have been dispatched.

For card payments, the purchase amount may be reserved at the time of ordering and charged on the day the item is shipped.

For invoice payments, the invoice is issued upon shipment with a minimum due date of 14 days.
Buyers under 18 years of age may not pay by invoice.

 


 

6. Delivery

Delivery is considered completed when the buyer or their representative has received the goods.

If no delivery time is stated in the ordering solution, the goods shall be delivered without undue delay and no later than 30 days after the order is placed.

Goods are delivered to the address provided by the buyer unless otherwise agreed.

 


 

7. Risk of Loss

The risk transfers to the buyer when the goods are delivered in accordance with Section 6.

 


 

8. Right of Withdrawal

Unless exempt, the buyer may withdraw from the purchase in accordance with the Right of Withdrawal Act.

Withdrawal Period

The buyer must notify the seller within 14 days from:

  • the day after receipt of a single item

  • the day after receipt of the first delivery (subscriptions/recurring deliveries)

  • the day after receipt of the final item in a split delivery

The deadline is met if notice is sent before expiry. Notification should be in writing.

Exceptions to the Right of Withdrawal

The right of withdrawal does not apply to:

  • Goods made or customized according to the buyer’s specifications

  • Goods clearly marked “Final Sale”, “non-returnable”, or “discounted – no returns”, where this is clearly stated prior to purchase and on the product page

These are covered by Section 22(e) of the Right of Withdrawal Act and cannot be returned.

Returns

The buyer must return the goods no later than 14 days after notifying withdrawal.
The buyer covers return shipping unless otherwise agreed.

The buyer may try the item only to determine its nature, characteristics, and function. Excessive use may result in compensation for diminished value.

The seller will refund the purchase amount no later than 14 days after receiving withdrawal notice but may withhold payment until the goods are returned or shipment is documented.

 


 

9. Delay or Non-Delivery

The provisions of Chapter 5 of the Consumer Purchases Act apply.

Depending on circumstances, the buyer may withhold payment, demand fulfillment, cancel the purchase, and/or claim compensation.

Notice of breach should be in writing.

 


 

10. Defects – Complaints

If the goods have a defect, the buyer must notify the seller in writing within a reasonable time after discovering or when they should have discovered the defect.

Complaints within 2 months are always considered timely.
The absolute deadline is 2 years, or 5 years if the product is intended to last significantly longer.

In case of defects, the buyer may:

  • withhold payment

  • request repair or replacement

  • request a price reduction

  • cancel the purchase if the defect is not insignificant

  • claim compensation

The seller normally has the right to two attempts at remedy.

 


 

11. Seller’s Rights in Case of Buyer’s Breach

If the buyer fails to pay or breaches their obligations, the seller may:

  • withhold the goods

  • demand fulfillment

  • cancel the agreement

  • charge interest and collection fees for late payment

Uncollected Parcels

For uncollected goods not prepaid, the seller may charge a fee corresponding to actual shipping and handling costs.
Buyers under 18 years of age may not be charged such fees.

 


 

12. Warranty

Any warranties are in addition to statutory rights and do not limit the right to complain.

 


 

13. Personal Data

Boost Sportswear AS is the data controller.

Personal data such as name, address, phone number, and email are stored to complete purchases and manage customer relationships. Processing complies with GDPR and Norwegian data protection law.

Personal data is only shared when necessary to fulfill the agreement (e.g., with shipping providers) or when required by law.

Marketing, newsletters, or other communications are sent only with explicit consent, which can be withdrawn at any time.

 


 

14. Gift Cards

Boost Sportswear AS offers digital and/or physical gift cards.

Gift cards are valid for 1 year from purchase unless otherwise stated.
Gift cards cannot be exchanged for cash and cannot be returned under the Right of Withdrawal Act exemption for financial services.

 


 

15. Dispute Resolution

Complaints should be directed to the seller within a reasonable time.

The parties shall attempt to resolve disputes amicably. If unsuccessful, the buyer may contact:
